Metals Research Technologies, LLC (hereafter “MRT”) takes the privacy of its customers seriously, which is why we have drafted this Privacy Policy (hereafter “Policy”) to describe how MRT collects, uses, discloses, transfers, stores, retails or otherwise processes information related to you (“Personal Data”) when you, in your business or professional capacity, access or use, in any manner, our mobile applications (hereafter referred to as the “Platforms”) which we provide to our customers. This Policy forms part of our Terms of Service. The Platforms we provide are intended for commercial use only. We do not intentionally collect Personal Data of individuals who are not using it for their businesses. II. Does MRT Use Tracking Technologies
MRT does not use cookies or pixels, or any third party analytics tools that track your use of the Platforms for any purpose, including to operate, improve, or advertise on the Platforms.
III. How We Share Personal Data
In the course of our business we may share Personal Data with third parties for our legitimate business purposes or to comply with our legal requirements. We share personal data with the following third parties:
  • Subsidiaries and Affiliates: In order to provide our Platforms, operate our website, troubleshoot bugs and provide technical support, we may collect log information about your use of the platform from our third-party service providers.

  • Payment Processors: We never will ask for your payment card information directly, instead we use PCI-DSS compliant payment processors to process all transactions on our behalf.   • Third-Party Auditors: We are subject to audits by our regulators, customers and service providers. We ensure that any Personal Data that may be disclosed is kept secure and confidential when we allow for and contribute to third party audits, and that auditors only use the information to complete the audit.

  • In addition, we may share your Personal Data in the event of a corporate restructuring, such as a merger, acquisition or dissolution, and where necessary to comply with law, such as in response to a subpoena.
IV. De-Identified and Aggregate Data
MRT may de-identify and aggregate data for its business purposes, including but not limited to, to improve the products and features of its Platforms, to maintain the security and integrity of its systems, for analytics, and other legitimate business purposes. “De-identified Data” means information that cannot reasonably be used to infer information about, or otherwise be linked to a particular data subject. Where we process De-identified Data, we commit to maintain and use the information in de-identified form and not attempt to reidentify the information, except where permitted by law. Company may disclose De-identified Data to third parties who commit themselves to maintaining the De-identified Data in de-identified form and not attempt to re-identify the data for any business purpose.
V. Disclosures Applicable To California Residents
This section applies to residents of California.
The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, “CCPA”) requires that we disclose certain information to California residents regarding their Personal Data, the Legal Categories of Personal Data we have collected (including the source, purpose, and business purposes we may share your Personal Data and with whom), and the process for exercising your rights under California Law. We use the term Personal Data in this Policy, which shall have the same meaning as “Personal Information” under the CCPA. All capitalized terms used in this Section not defined in this Policy shall have the same meanings as given under the CCPA.

  1. California Privacy Rights
For the Personal Data that we collect about you pursuant to this Policy, you may have the following rights or choices that we will accommodate where your requests meet legal and regulatory requirements and do not risk making our other data less secure or changing our other data. You may also designate an authorized agent to make a request on your behalf.

You may have the right to know the categories of Personal Data collected about you, the business purposes we use and share your Personal Data, and to know whether your Personal Data is disclosed / Sold and to whom. You also may have the right to access your Personal Data and to receive a copy of your information.
Deletion:
You also may request that we delete your Personal Data. Note, however, that we may not always be able to comply with your request to delete for specific legal reasons, in which case we will notify you of these reasons.
Limit Use and Disclosure of Sensitive Personal Data:
You may have the right to direct us to limit our use of your sensitive Personal Data to that use which is necessary to perform the services and which is reasonably expected by the average consumer requesting the services.

Opt out of Profiling and/or Cross-Context Behavioral Advertising:
You may have the right to opt out of the Processing of your Personal Data for the purposes of Cross Context Behavioral Advertising or Profiling which is used in furtherance of decisions that produce legal or similarly significant effects. “Profiling” means any automated processing of Personal Data to evaluate, analyze, or predict aspects concerning an individual’s economic situation, health, personal preferences, interest, reliability, behavior, location or movements. We do not engage in Profiling or Behavioral Advertising activities.

You may have the right to request correction of the Personal Data that we hold about you. We may need to verify the accuracy of the new data you provide to us.

We do not share “Personal Information” as defined by California’s “Shine the Light” law with third parties with non-Affiliate third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with the Shine the Light law and/or withdraw previously given consent to sharing with non-Affiliate third parties for their direct marketing purposes by contacting using the methods in the Contact Us section below. Requests must include “California Marketing Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the provided e-mail address or mailing address.

If you are a California Resident and you would like to make a request to exercise any of your privacy rights, you should contact us via one of the methods provided in the Contact Us section below.
Verification:
For some requests, we may be required to verify your identity, meaning that we may need to make sure that you are the individual about whom the Personal Data we hold relates. Where we request information to verify your identity, we will not ask you to provide new information that we do not already hold about you, unless necessary.
Responding to Requests:
Your request will be evaluated to determine whether the request meets the legal requirements and if we are able to honor it. For example, we may not be able to re-identify information relating to an individual who downloads our Platforms but is not a registered user. We make every effort to respond to privacy requests within forty-five (45) days of when they were made to us. In the event that we need more time, we will notify you.
Requests by Authorized Agents:
You may designate an authorized agent to make a request on your behalf. Privacy laws require that any request you submit to us is subject to an identification and verification process, and confirmation of the agent’s authority, which may include attestation under penalty of perjury. Absent a power of attorney, we will also require the consumer to verify their own identity. We may verify identity based on matching information you provided with data we have maintained on you in our systems.
VI. Data Retention
We will only retain your Personal Data for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.
We cannot (fully) comply with a request to erase or delete if we have to retain your Personal Data for certain purposes and for a longer period due to a statutory retention period. After the retention period has expired, we will delete your Personal Data.
VII. How We Secure Your Personal Data
We strive to maintain technical, physical, and administrative security measures designed to provide reasonable protection for your Personal Data against loss, misuse, unauthorized access, disclosure, and alteration. Security measures may include firewalls, data encryption, access controls to our data centers, and information access authorization controls.
While we are dedicated to securing our systems and Platforms, we cannot guarantee that loss, misuse, or alteration will never occur. Please keep in mind that no method of storage or transmission over the internet is completely secure, so your use of our Platforms and provision of information to us is at your own risk.
Do not share your password(s) and account information with anyone. You are responsible for maintaining and verifying that the Personal Data we hold about you is accurate and current. We recommend that when you complete your online transactions to log off completely whenever you are done using our Platforms.
VIII. Changes To This Policy
We reserve the right to change this Policy prospectively effective upon the posting of the revised Policy and your use of our websites indicates your acknowledgement of the Policy posted at the time of use. However, should we update this Policy, we will post a new version online, and will notify you if the Personal Data processed about you will be materially different than that which was represented to you at the time it was collected. To the extent any provision of this Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
